Bijan Amini,
born Cambridge, Massachusetts, 1954. Mr. Amini has a Masters in Economics and is a 1981 graduate of the University of Michigan Law School. He is admitted to practice in the District of Columbia and in New York, as well as in the United States District Courts for the Eastern and Southern Districts of New York and the District of Columbia.
Mr. Amini specializes in litigating complex commercial disputes and negotiating transactions, practicing before both federal and state courts, as well as various arbitral tribunals, including the National Association of Securities Dealers and the American Arbitration Association. He has prosecuted and defended claims under the federal antitrust, securities, bankruptcy and RICO statutes. He is also experienced in professional malpractice, employment and intellectual property litigation. Representative matters he has handled since the firm was founded include acting as counsel for New York City and Erie County in their suits against the tobacco companies; representing an oscar winning producer and prominent screenwriter in a copyright infringement action against a major studio; defending a prominent contemporary art dealer on fraud claims by the Internal Revenue Service; prosecuting a major antitrust suit on behalf of an association of independent financial counselors against the National Foundation for Consumer Credit; several complex, multimillion dollar breach of contract actions against different Fortune 50 companies; a derivative action against the general partner of five publicly-traded real estate partnerships; a number of trademark and unfair competition actions; and a tariff discrimination suit against a major telecommunications carrier. Mr. Amini currently represents a number of bankruptcy trustees against the former officers and directors of debtors and various professionals employed by them, as well as in preference actions in selected matters. Mr. Amini also handles malpractice actions both for and against attorneys, accountants and other professionals, and has extensive experience in litigating coverage disputes with insurance carriers. He also has an extensive practice counseling and litigating on behalf of professionals, generally at the managing director level, in employment disputes with major brokerage and other financial institutions. Mr. Amini negotiates contracts as well, most recently on behalf of start-up companies with angel investors, certain hotel and restaurant-related management contracts and contracts for professionals in the media and film industry. Mr. Amini has also acted as a Court-appointed referee and mediator in a number of complex commercial cases pending in the New York Courts.
Mr. Amini was previously associated with the firms of Arnold & Porter, in Washington, D.C., and Fried, Frank, Harris, Shriver & Jacobson, in New York, where his primary practice areas were commercial and securities litigation.
